Terms of Service

1. Agreement to Terms

By creating an account or using AutoInvoice ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you ("User") and AutoInvoice ("we", "us", "our"), governed by the laws of the Republic of South Africa.

2. The Service

AutoInvoice provides a web-based motor vehicle invoicing platform that allows users to:

• Create and share professional invoice PDFs
• Manage client records (dealerships and private individuals)
• Track sales representatives and generate sales reports
• Store business and invoicing data securely in the cloud

The Service is intended for use by South African motor vehicle dealers, traders and related businesses. AutoInvoice is provided "as is" and we reserve the right to modify, suspend or discontinue any feature at any time.

3. Account Registration

To use AutoInvoice you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Verify your email address
• Maintain the security of your password

You are responsible for all activity that occurs under your account. If you suspect unauthorised access, notify us immediately at support@autoinvoice.co.za.

We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in fraudulent activity.

4. Subscription Plans & Billing

Free Plan

The Free Plan allows up to 5 invoices per calendar month at no charge. Free plan features may be modified at our discretion with reasonable notice.

Pro Plan

The Pro Plan costs R250.00 per month (VAT inclusive where applicable) and provides unlimited invoices and full access to all features.

• Billing is processed monthly through PayFast by Network
• Your subscription renews automatically on the same date each month
• By subscribing you authorise PayFast to charge R250.00 to your payment method monthly
• Prices may change with 30 days written notice to your registered email address

Cancellation

You may cancel your Pro subscription at any time through the Options tab in the app.

Refunds

All subscription payments are non-refundable except where required by South African consumer protection law. If you believe you have been charged in error, contact us within 7 days at support@autoinvoice.co.za.

5. Acceptable Use

You agree to use AutoInvoice only for lawful purposes. You must not:

• Use the Service for any fraudulent, illegal or deceptive purpose
• Create invoices for transactions that did not occur
• Attempt to gain unauthorised access to other users' accounts or data
• Reverse engineer, copy or redistribute the Service
• Use automated tools to scrape or extract data from the Service
• Violate any applicable South African law including the Consumer Protection Act or FICA

Violation of these rules may result in immediate account suspension without refund.

6. Your Data & Content

You retain full ownership of all data you input into AutoInvoice, including client details, invoice records and business information.

By using the Service, you grant AutoInvoice a limited licence to store, process and display your data solely for the purpose of providing the Service to you.

You are responsible for ensuring that any personal information you capture about your clients (SA ID numbers, contact details etc.) complies with POPIA and that you have a lawful basis for collecting such information.

7. Availability & Uptime

We aim to provide a reliable service but do not guarantee 100% uptime. The Service may be temporarily unavailable due to:

• Scheduled maintenance (with advance notice where possible)
• Unplanned technical issues
• Third-party service outages (Supabase, Netlify, Resend)

We are not liable for any losses resulting from service interruptions.

8. Limitation of Liability

To the maximum extent permitted by South African law, AutoInvoice shall not be liable for:

• Any indirect, incidental or consequential damages arising from use of the Service
• Loss of business, revenue or data
• Errors in invoices generated through the Service
• Any disputes between you and your clients arising from invoices

AutoInvoice is a tool to assist you in creating invoices. You remain solely responsible for the accuracy of the information entered and the legality of your business transactions.

9. Intellectual Property

All software, design, code, logos and content forming part of the AutoInvoice Service are the intellectual property of AutoInvoice and are protected by South African copyright law. You may not copy, reproduce or distribute any part of the Service without written permission.

The AutoInvoice name, logo and brand are trademarks of AutoInvoice. You may not use our brand in any way that implies endorsement or affiliation without prior written consent.

10. Termination

You may close your account at any time by contacting us at support@autoinvoice.co.za. Upon closure:

• Your access to the Service will be terminated immediately
• Your data will be deleted within 30 days (subject to legal retention requirements)
• No refund will be issued for any remaining subscription period

We reserve the right to terminate your account for violation of these Terms, with or without prior notice.

11. Governing Law & Disputes

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of the Service shall be subject to the jurisdiction of the South African courts.

We encourage you to contact us first at support@autoinvoice.co.za to resolve any disputes informally before pursuing legal action.

12. Changes to These Terms

We may update these Terms from time to time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
